Reports Suggest Biden Doing Repeat of Budget Control Act of 2011
No Deal is Better Than a Bad Deal: Invoke 14th Am and Const. Faithfully Execute Laws
Reports suggest Biden is negotiating a repeat of the terrible Budget Control Act of 2011. He has said differing things at various times. But we saw what he and Obama agreed to in 2011 during a similar Republican economic hostage taking, and they both regretted the deal: The Budget Control Act of 2011. The Republicans have shown no signs of compromising, and even if their leadership does, many Freedom Caucus Republicans are prepared to work to undermine and stop any compromise that does not give them 100% of what they want. Trump is egging them on to have the U.S. default on its debts just like Trump did many times with his various business debts.
The reports indicate that the potential deal has no benefits for Democrats, but compromising with economic hostage takers will only embolden them to do it again whenever a Democrat is in the White House. The 2011 deal was a debacle that both parties came to regret.
So here reports suggest we are headed for a similar deal that will undermine Democrats and reward Republicans. Why shoot yourself in the foot of your priorities? Why acquiesce to Republican demands for stringent work requirements even for sick people needing Medicaid or children needing food? Why impose caps on social welfare programs while continuing to fund the military at full budget authorizations.
Instead of rewarding the republican hostage takers, Biden should issue an Executive Order to the Treasury to continue borrowing as needed to fund programs authorized previously by Congress. Biden has authority to do so under Section 4 of the 14th Amendment and the clause in Article II that he faithfully execute all the laws of the United States.
If Republicans challenge that Executive Order, they will have an extraordinarily difficult time to establish standing to challenge debt issued to fund programs that Congress voted to authorize and for which Congress legislated appropriations. Who is individually hurt by issuing debt to fund Congressionally approved Budgets: No one. A Republican challenge will likely be dismissed for lack of standing to sue.
So Biden meet if you must with McCarthy, but get ready to issue your Executive Order to Treasury before X-date. Don’t give the Republican economic hostage takers another victory.
